Wisconsin Mother Pleads Guilty After Dropping 5-Day-Old Baby During Overdose, Causing Skull Fracture

GRAFTON, WISCONSIN — A 25-year-old Wisconsin mother has pleaded guilty to child neglect after her 5-day-old baby suffered skull fractures when she overdosed in the hospital and let the infant fall to the floor, police say.
According to court records, Janet Solis admitted to neglecting a child causing great bodily harm following the shocking incident that occurred in November 2024 at Aurora Medical Center in Grafton, a suburb north of Milwaukee.
Baby Found on Hospital Floor After Mother Overdosed
Police said nursing staff discovered the newborn lying on the tile floor beneath Solis’ hospital bed after she was found unconscious and “unrousable” around 2 a.m. on Nov. 4, 2024.
The infant was immediately treated and diagnosed with two linear skull fractures. A search of the hospital room revealed a Ziploc bag containing suspected cocaine or fentanyl, along with drug paraphernalia and vape devices that tested positive for THC.
Authorities later confirmed that Solis had overdosed on heroin while holding her baby, causing the child to fall.
“This was an absolutely preventable tragedy,” investigators said in the criminal complaint reviewed by Law&Crime.
Drug Use Before and During Pregnancy
The investigation revealed that Solis had used heroin and marijuana throughout her pregnancy and had avoided prenatal care out of fear that child protective services would intervene.
Toxicology reports showed Solis had marijuana and fentanyl in her system following the baby’s birth. The infant also tested positive for cocaine, fentanyl, and THC, and was experiencing withdrawal symptoms shortly after delivery on Oct. 29, 2024.
Solis reportedly told detectives she was a daily drug user, admitting her boyfriend, 25-year-old Devin Berg, brought her drugs during her hospital stay.
Boyfriend Also Charged in Connection With Neglect
Devin Berg was charged as a party to child neglect and is set to appear in court on Nov. 10. Investigators say he initially denied using drugs or knowing Solis was using them in the hospital, but later admitted that both were daily users.
When asked about the night of the fall, Berg told police he wasn’t present but recalled Solis calling him afterward, saying, “The nurses are being ridiculous about it.”
The couple also has a 3-year-old daughter, though authorities have not publicly confirmed who has custody of the children since their arrests.
Guilty Plea and Sentencing
Solis entered her guilty plea on Oct. 13, 2025, nearly one year after the incident. A Wisconsin judge sentenced her to two years in prison followed by four years of extended supervision.
The case, officials say, highlights the devastating consequences of substance abuse during pregnancy and the urgent need for addiction intervention and parental monitoring in hospital settings.
